looking bewilderebewildered. >> reporter: good morning. suspect james holmes is back in s solitaire confinement this morning. his family is standing by him and they're concerned about the death penalty. investigators for james holmes defense team are scheduled to be inside the century 16 theater today looking for any evidence they can find which could help defend their client. on monday, holmes appeared in court for the first time for a preliminary hearing. his hair was dyed orange red and he had a dazed look as a judge advised him about his rights and his alleged crime. >> you committed the offense of first-degree murder which is a class 1 felony under colorado law. >> reporter: some of the victim's families were inside the room including ian sullivan,

the father of veronica moser-sullivan. david waited outside of the courtroom. his son was shot in the head and is in critical condition. >> to feel the pain in there makes you more angry about this man that decided to take everybody's life. >> reporter: prosecutors have 60 days to decide whether to seek the death penalty in that time the district attorney says she'll talk with the victims' families to get their advice. >> if the death penalty is sought, that's a very long process that impacts their lives for years. so they will want to have and we will want to get their input before we make any kind of a decision on that. >> reporter: holmes' father was here in colorado to support his son. the family attorney spoke with the media. >> their hearts go out to the victims and their families. yes, they do. he's their son. >> reporter: holmes will be formally charged monday. we're getting a little bit of good news about some of the

survivors. hospital officials say two more survivors have been released and one is doing better. seven people are still in critical condition. >> good to hear. thank you so much. president obama is warning the syrian government against using its chemical weapons arsenal. syria says it will use chemical weapons if it face as foreign attack but not to put down the rebellion against the assad government. it is believed that syria stockpiled missiles of delivering them. >> we will continue to make it clear to assad and those around him that the world is watching and that they will be held accountable by the international community and the united states should they make the tragic mistake of using those weapons. >> the arab league offered assad safe exit should he step down.

romney will be in nevada where the economy is the main topic in particular the issue was helping small business, something that romney said was a priority of his. spe speaking in california yesterday. >> if you're employing people and hiring people, i want to see you do better because i want more people having good wages and better benefits. >> romney begins an overseas trip tomorrow with stops in britain, israel and poland. penn state's prestigious program has been sacked. the university agreed to a crushing list of penalties imposed by the ncaa for failing to act in the jerry sandusky sex abuse scandal. the "sports illustrated" cover sums it up. we were penn state. once a football powerhouse, the school will be crippled on the gridiron for years to come. >> reporter: the late joe paterno is no longer the winningest coach in football history. one day after his campus statue came down, the ncaa took away

all of his victories from 1998 to 2011. it's part of the sanctions imposed in the jerry sandusky sex abuse scandal. >> the 1998 date was selected because that's when the first reported incidents of abuse occurred and that's when the failure to respond appropriately began. >> reporter: the ncaa also fined penn state $60 million, banned the football team from postseason play for four years. university officials accepted the penalties saying she will require penn state to move forward. many students believe the ncaa went too far. >> i just don't think its fair that they took away joe pa's record. >> too much. the people who should be punished are sandusky and those that covered it up and not the players and new coaches. >> reporter: ncaa stopped short of imposing the so-called death penalty which would have canceled games for a year or

more. >> suspension of the football program would bring with it significant unintended harm to many who had nothing to do with >> reporter: joe paterno's family released a statement saying the sanctions defamed the legacy and contributions of a great coach and educator without any input from our family or those who knew him best. a little later on "cbs morning news," ncaa president will discuss the crushing sanctions imposed on penn state and its program. sally ride changed the face of the american space program at a time when the u.s. astronaut core was dominated by military test pilots, she became the first american woman in space. ride died yesterday after a 17-month battle with pancreatic cancer. >> reporter: sally ride was a physicist when she answered an ad seeking applicants for the space program. in 1983, she became the first american woman in space. >> the thing i'll remember most

about that flight is that it was fun and in fact i'm sure it's the most fun i'll ever have in my life. >> let me just remind you that when we had lunch here at the white house before your flight, that somebody said that sometimes the best man for a job was a woman. you were there because you were the best person for the job. >> reporter: she flew again in 1994 and served on a panel investigating the "challenger" disaster and inspired countless young women to pursue careers in science. she developed science themed camps, festivals and classes for children who dreamed about reaching for the stars. >> it's a real experience and the experience of a lifetime to be able to fly in space and fly aboard the space shuttle and i have to admit i'm more excited about that opportunity than i am about being the -- as you say a footnote in history. >> reporter: today president obama called sally ride a national hero and a role model.

good morning. >> reporter: good morning. europe's debt woes are piling up once again. spain's borrowing costs increased raising the risk it will require a bailout. moody's downgraded its outlook on credit ratings for germany, netherlands and luxembourg citing instability in europe and possibility those stronger countries may have to fund future bailouts. asian markets fell slightly this morning. both japan's nikkei dropped a faction and hang sang sunk only 1%. today we'll get apple's earnings report after the closing bell. they believe consumers may be waiting for the next version of the iphone to be released. the unease over europe pushed stocks on wall street lower. the dow lost 101 points while the nasdaq was down 35. the nasdaq is raising the amount it will offer brokers that lost money because of technical glitches during facebook's ipo. the exchange will pay out $62 million up from 40 million it

proposed in june. however, some experts say the trading losses may have added up to more than $200 million. the government is investigating chrysler's two top selling victims. the national highway traffic safety administration is looking into 2009 and 2010 dodge ram pickup trucks. the agency says the rear wheels can lock up and potentially cause crashes. the investigation also includes 2012 jeep grand cherokees. power steering fluid can leak causing engine fires. american airlines is trying to make things more comfortable for passengers flying from coast to coast. the airline will be the first to offer live flat seats on transcontinental flights. several airlines make them available on international flights. american will use the new seats in first and business class on flights between new york and california. i think our trip to l.a. is looking up. >> we'll probably have to pay an arm and a leg for it but we
